Welcome to Aviary. These Terms of Service ("Terms") govern your use of the Aviary documentation website (aviary-docs.vercel.app), the @ru1vly/aviary open-source software, command-line tools, libraries, and related resources.
Aviary is free and open-source software licensed under the MIT License. Nothing in these Terms restricts or supersedes your rights under the MIT License.
# 1. Acceptance of Terms
By visiting the Aviary documentation website, or by installing, downloading, or running the Aviary CLI, MCP server, or programmatic libraries, you agree to be bound by these Terms and all applicable laws and regulations. If you do not agree with these Terms, you should discontinue using the software and documentation.
# 2. Open-Source License & Precedence
The Aviary core engine, CLI, and documentation are made available as open-source software under the MIT License.
You are entitled to use, copy, modify, merge, publish, distribute, sublicense, and sell copies of the software in accordance with the terms of the MIT License. In the event of any conflict between these Terms and the MIT License, the MIT License shall govern with respect to the source code.
# 3. Acceptable Use & Auditing Responsibilities
Aviary is an automated testing and browser auditing toolkit designed for developers, site owners, and QA engineers. Because Aviary issues automated HTTP requests and renders web pages via browser automation:
- Authorization: You agree to use Aviary only on websites, web applications, and endpoints that you own, operate, or have express authorization to audit.
- Respect for Target Infrastructure: You agree not to use Aviary in any manner that could damage, disable, overburden, or impair target servers, or interfere with any other party's use of a website (including denial-of-service attempts or abusive request floods).
- Robots.txt and Crawling Policies: You are responsible for respecting target website rate limits, crawling guidelines, robots exclusion standards (
robots.txt), and terms of service. - Compliance with Laws: You are solely responsible for ensuring that your auditing activities comply with all applicable local, national, and international cybersecurity, computer fraud, and data privacy regulations.
# 4. Nature of Automated Audits & Disclaimer of Warranties
- Diagnostic Guidance Only: Aviary's audit checks (spanning SEO, Core Web Vitals, accessibility heuristics, security headers, and structured data) are automated diagnostic guidelines. They do not constitute certified legal, accessibility, or security compliance advice.
- No Search Engine Ranking Guarantees: Audit scores and recommendations are based on publicly documented best practices. Aviary makes no representation or warranty that resolving issues identified by the tool will result in specific search engine rankings or traffic improvements.
- Disclaimer: THE SOFTWARE, DOCUMENTATION, AND AUDIT REPORTS ARE PROVIDED "AS IS", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. THE AUTHORS AND CONTRIBUTORS DO NOT WARRANT THAT THE SOFTWARE WILL OPERATE UNINTERRUPTED OR ERROR-FREE.
# 5. Limitation of Liability
IN NO EVENT SHALL THE AUTHORS, MAINTAINERS, CONTRIBUTORS, OR COPYRIGHT HOLDERS BE LIABLE FOR ANY CLAIM, DAMAGES, LOSS OF DATA, LOSS OF PROFITS, SERVICE DISRUPTION, OR OTHER LIABILITY, WHETHER IN AN ACTION OF CONTRACT, TORT, OR OTHERWISE, ARISING FROM, OUT OF, OR IN CONNECTION WITH THE SOFTWARE, THE DOCUMENTATION, AUDIT RESULTS, OR THE USE OR OTHER DEALINGS IN THE SOFTWARE.
# 6. Contributions and Community Submissions
Any pull requests, issues, feature ideas, or documentation contributed to the Aviary GitHub repository are submitted under the terms of the MIT License, unless explicitly stated otherwise in a separate written agreement.
# 7. Third-Party Services
Aviary relies on external dependencies and developer tools (including Node.js, Playwright, and npm packages). Your use of third-party software and hosting platforms (such as GitHub or Vercel) is subject to the respective terms and licenses of those providers.
# 8. Modifications to Terms
We reserve the right to amend these Terms at any time. Changes will be documented in our public version-control history and published on this page with an updated effective date. Continued use of Aviary software or documentation constitutes acceptance of modified terms.
